Who operates this service
Still By My Side is operated by Handsome Habits LLC. These Terms of Service govern your access to and use of the website, checkout, account features, private gallery, subscriptions, support, and related services.
Your responsibility for submitted materials
You represent that you own or have permission to use every photo, name, story, review, testimonial, and other material you submit, and that your submission and our use of it will not violate another person's rights or any law.
License to use submitted content
When you submit content or buy from Still By My Side, you grant Handsome Habits LLC a perpetual, worldwide, royalty-free, transferable, sublicensable license to host, store, copy, edit, adapt, display, publish, distribute, create derivative works from, advertise with, and otherwise use submitted photos, finished keepsakes, names, reviews, testimonials, order context, and related materials to provide, operate, improve, advertise, and promote the service.
Promotional use
Purchase is enough consent for Handsome Habits LLC to use submitted content and finished keepsakes in public examples, ads, social posts, portfolio materials, website displays, testimonials, reviews, and related promotional uses, unless applicable law requires a different permission.
Purchases and payment handling
Payments are collected through hosted Stripe Checkout. Still By My Side does not run a custom card form or store full card numbers. Prices, package details, subscription details, taxes, and other checkout terms are shown at checkout before purchase.
Refund guarantee
One-time keepsake orders and the first Still Together subscription charge are protected by a 100% refund guarantee. Later subscription renewals are not covered by this guarantee. Approved full refunds may revoke or remove access to finished keepsakes, downloads, private gallery access, or related account benefits.
Subscriptions
Still Together subscriptions renew until canceled. You are responsible for canceling before the next renewal if you do not want another charge. Subscription access, timing, reminders, and delivery features may change as the service evolves.
Keepsake results
Finished keepsakes are created from the photos and details you provide. Results can vary, and we do not promise that every image will match every detail, pose, memory, expectation, or preferred style.
Accounts and order access
You are responsible for using an email address you can access, signing in to claim your order, keeping your account secure, and contacting support if a paid order is not visible in your account.
Prohibited uses
You may not use the service to submit content you do not have the right to use, violate another person's rights, break the law, interfere with the service, bypass security or payment controls, scrape private areas, or submit abusive, deceptive, harmful, or unlawful material.
Third-party services
The service depends on third-party providers for payment, hosting, authentication, database, storage, email, advertising, analytics, background jobs, and other operations. We are not responsible for third-party services, outages, policies, or acts outside our control.
Availability and changes
We may modify, suspend, discontinue, limit, replace, or change any part of the service, pricing, packages, subscriptions, features, vendors, or delivery process at any time. We do not guarantee uninterrupted availability or any specific delivery time unless a written offer says otherwise.
Disclaimer of warranties
The service and all finished keepsakes are provided as is and as available. To the fullest extent permitted by law, Handsome Habits LLC disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted operation.
Limitation of liability
To the fullest extent permitted by law, Handsome Habits LLC will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-data, emotional distress, or replacement-cost damages. Our total liability for any claim is limited to the maximum amount you paid for the order or subscription charge giving rise to the claim.
Indemnity
You agree to defend, indemnify, and hold harmless Handsome Habits LLC from claims, losses, liabilities, damages, costs, and expenses arising from your submitted content, your violation of these terms, your misuse of the service, or your violation of another person's rights.
Governing law
These terms are governed by the laws of the state where Handsome Habits LLC is organized, without regard to conflict-of-law rules, unless applicable consumer law requires another rule.
Changes to these terms
We may update these terms as the service, business, vendors, or law changes. The updated terms will be posted on this page, and continued use of the service after an update means the updated terms apply.
